Update: The Gap, Inc. v. Gapnote

In October, this blog discussed the case of The Gap, Inc. v. Gapnote. The Gap, a clothing manufacturer and international retailer, sued Gapnote, a start-up social media site, and the site’s CEO, Mr. Greg Murphy, for trademark infringement.

As of this posting, it appears that The Gap has prevailed. Any visitor to www.gapnote.com is redirected to The Gap (www.gap.com).  As reported on www.taxation.ie, the two companies settled and Gapnote changed its name to Happeo. You may find the new company at www.happeo.com.

The settlement and name change were likely necessary for a start-up company such as Gapnote (now Happeo) to avoid the time, expense and resources required to take on an established corporation like The Gap.
